1. Acceptance of Terms
By accessing, browsing, or using the QikDoc platform (including our website and mobile application), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and to comply with all applicable laws and regulations.
Important: If you do not agree to these Terms, you must not access or use the QikDoc platform.
QikDoc reserves the right to modify, amend, or update these Terms at any time without prior notice. Your continued use of the platform after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
2. Eligibility
By using QikDoc, you represent and warrant that you meet the following eligibility criteria:
For Patients
- At least 18 years of age
- Legally competent to enter into contracts
- Authorized to provide health information for family members
For Doctors
- Valid medical license (NMC/State registration)
- Qualified MBBS/MD/MS or equivalent
- Good standing with medical council
For Vendors
- Valid business license (Pharmacy/Drug License/Lab License)
- GST registration
- Compliance with applicable healthcare regulations
Minors (under 18) may only use the platform with parental or guardian consent and supervision.
3. Services Provided
QikDoc is a technology platform that facilitates healthcare services. Our services include:
Teleconsultation Services
Connect with qualified Registered Medical Practitioners (RMPs) holding valid MCI/NMC or state medical council registration for online medical consultations via video, audio, or chat.
Digital Prescriptions
Receive structured digital prescriptions from doctors that can be used to order medicines or lab tests through our platform.
Medicine Ordering
Order prescribed medicines from verified pharmacy vendors with home delivery options.
Lab Test Booking
Book diagnostic lab tests and imaging services from verified labs with home sample collection options.
Health Record Management
Store and manage your health records, prescriptions, lab reports, and health metrics securely in one place.
AI Symptom Analysis
Get preliminary AI-driven symptom analysis to guide you before booking a consultation.
QikDoc is a technology intermediary, NOT a hospital, medical establishment, or healthcare provider. We facilitate connections between patients, doctors, and vendors but do not provide medical services directly.
4. User Obligations
As a user of QikDoc, you agree to the following obligations:
Accurate Information
Provide accurate, complete, and up-to-date information during registration and when creating health profiles. You are responsible for maintaining the accuracy of your information.
Account Security
Maintain the confidentiality of your login credentials (username, password, OTP). You are responsible for all activities that occur under your account.
Lawful Use
Use the platform only for lawful purposes. Do not misuse the platform for illegal activities, fraud, or emergency medical situations.
Respectful Conduct
Treat doctors, vendors, and support staff with respect. Harassment, abusive language, or threatening behavior will result in account suspension.
Medical Information
Provide complete and honest medical history, symptoms, and health information to doctors during consultations for accurate diagnosis and treatment.
No Platform Manipulation
Do not attempt to manipulate the platform, bypass security measures, or interfere with the platform's functionality.
Violation of these obligations may result in immediate suspension or termination of your account without prior notice.
5. Medical Disclaimer
NOT FOR EMERGENCIES
QikDoc is NOT intended for medical emergencies. If you are experiencing a medical emergency, life-threatening condition, or severe symptoms, immediately call your local emergency number (108/102 in India) or go to the nearest hospital emergency room. Do not delay seeking in-person medical care because of information obtained through QikDoc.
Important Disclaimers:
Teleconsultation Limitations
Online consultations may be limited by the lack of physical examination. Doctors can only diagnose and treat based on the information you provide.
AI Symptom Checker
The AI symptom analysis is for informational purposes only and does NOT constitute medical advice, diagnosis, or treatment. Always consult a qualified doctor for medical concerns.
Prescription Compliance
Follow your doctor's prescription instructions carefully. Do not share prescriptions with others. Consult your doctor before stopping or changing any medication.
No Doctor-Patient Relationship
Using QikDoc does not establish a traditional doctor-patient relationship. The platform facilitates consultations but doctors maintain independent professional relationships with patients.
Treatment Outcomes
QikDoc does not guarantee specific treatment outcomes. Medical results vary based on individual conditions, compliance with treatment, and other factors.
Best Practice: For ongoing health conditions, maintain regular follow-ups with your healthcare provider and keep them informed about any online consultations you have.
6. Doctor & Vendor Responsibilities
Doctor Responsibilities
- Maintain valid medical license and registration
- Comply with Telemedicine Practice Guidelines, 2020
- Verify patient identity before consultation
- Maintain patient confidentiality
- Provide accurate diagnosis and prescriptions
- Display registration number on prescriptions
- Avoid prescribing Schedule X or controlled substances
- Maintain medical records for minimum 3 years
Vendor Responsibilities
- Maintain valid business and drug/lab licenses
- Provide genuine products and services
- Comply with Drugs and Cosmetics Act, 1940
- Fulfill orders in a timely manner
- Upload accurate lab reports
- Maintain quality standards
- Protect customer data and privacy
- Provide accurate pricing information
Independent Liability: Registered doctors and vendors are solely responsible for the services, advice, diagnoses, prescriptions, and products they provide. QikDoc facilitates the platform but does not assume liability for their professional services.
7. Payments & Refunds
Payment Processing
- All payments are processed securely through PCI-DSS compliant payment gateways
- We accept Credit/Debit Cards, UPI, Net Banking, and Digital Wallets
- Payment is required at the time of booking/order placement
- All prices are in INR and include applicable taxes
Invoicing
- Digital invoices are generated for all transactions
- Invoices are accessible from your account
- GST invoices provided for vendor orders
- Platform fees are transparently disclosed
Refund Policy
Consultation Refunds
Free cancellation up to 24 hours before appointment. Partial refund for cancellations within 24 hours. No refund for no-shows or after consultation begins.
Order Refunds
Refunds available before order dispatch. After dispatch, returns subject to vendor policy. Defective/wrong items eligible for full refund.
Processing Time
Approved refunds are processed within 5-7 business days to the original payment method.
Non-Refundable
Platform fees, completed consultations, and customized services are generally non-refundable.
8. Limitation of Liability
To the maximum extent permitted by applicable law, QikDoc, its directors, employees, agents, and affiliates shall NOT be liable for any:
Direct or indirect damages
Medical outcomes or treatment results
Delays in service delivery
Third-party vendor performance
Internet connectivity issues
Force majeure events
Maximum Liability: In no event shall QikDoc's total liability exceed the amount paid by you for the specific service giving rise to the claim, or ₹1,000 (one thousand rupees), whichever is less.
Indemnification: You agree to indemnify and hold harmless QikDoc from any claims, damages, losses, or expenses arising from your use of the platform, violation of these Terms, or violation of third-party rights.
9. Intellectual Property
All content, features, and functionality of the QikDoc platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of QikDoc Health or its content suppliers and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

- Documentation and content
User Content
You retain ownership of your personal health data. By using the platform, you grant QikDoc a limited license to store, process, and display your data as necessary to provide services.
Unauthorized use, reproduction, distribution, or modification of QikDoc's intellectual property is strictly prohibited.
10. Privacy & Data Protection
Your use of QikDoc is also governed by our Privacy Policy. By using the platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

We do not sell, rent, or trade your personal health information to third parties. Your data is used solely for providing healthcare services and improving the platform.
11. Termination
By User
You may terminate your account at any time by:
- Contacting support at info@qikdoc.com
- Using the "Delete Account" option in settings
Note: Medical records are retained for 3 years as per regulations.
By QikDoc
QikDoc may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity
- Non-payment of fees
- Professional misconduct (doctors/vendors)
12. Governing Law & Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Jurisdiction
Any disputes arising out of or relating to these Terms or the use of QikDoc shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
Dispute Resolution Process
Direct Negotiation
First attempt to resolve the dispute through direct communication with our support team.
Mediation
If direct negotiation fails, both parties agree to attempt mediation before pursuing legal action.
Legal Proceedings
If mediation fails, disputes shall be resolved through courts in Mumbai, India.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
